The rule

60 days after termination of tenancy AND delivery of possession. Landlord must mail refund and/or written itemized list of deductions. (Deadline was extended from 35 days to 60 days by the Legislature — older sources citing 35 days are stale.)

Watch out in Alabama:
  • Tenant must provide a valid forwarding address in writing on vacating; without it, landlord mails to last known address (first-class mail suffices as compliance).
  • Any deposit or outstanding check unclaimed for 90 days after mailing is forfeited by the tenant (§ 35-9A-201(d)).
  • Deposit cap: one month's rent, plus extras allowed only for pets, planned changes to premises, or increased liability risk. No interest required.

What happens if your landlord misses the deadline

In Alabama, a missed deadline seriously weakens your landlord's position. Depending on the circumstances, they may forfeit the right to deduct anything at all, owe you the penalty above, or both.
