The rule

20 days after expiration or termination of the rental agreement: landlord must remit deposit AND provide an itemized list of damages with estimated repair costs, tendering payment of the difference (§ 5514(e)–(f)).

Watch out in Delaware:
  • Escrow REQUIRED: deposit must be held in a federally-insured institution with a Delaware office; landlord must disclose the account location within 20 days of tenant's written request — failure = FORFEITURE of the deposit to the tenant.
  • Failure to provide the itemized list within 20 days = landlord's acknowledgment that no damages are due (§ 5514(f)).
  • Tenant must OBJECT IN WRITING within 10 days of receiving the tendered payment, or the damages as stated are deemed agreed.
  • Tenant should provide a forwarding address in writing at or before termination (per Legal Services of Delaware guidance). No interest required.

What happens if your landlord misses the deadline

In Delaware, a missed deadline seriously weakens your landlord's position. Depending on the circumstances, they may forfeit the right to deduct anything at all, owe you the penalty above, or both. The exact consequence depends on 25 Del. Code § 5514 (deadline at (e)–(f); penalties at (g)) and whether they provided the required itemized statement. Don't assume the money is gone — a missed deadline is often the strongest fact pattern for getting it back.
