Kansas Security Deposit Return Deadline

30 days
How long your Kansas landlord has to return your deposit
Penalty for missing it
1.5x (failure to comply with the return rules — tenant recovers the deposit due plus damages equal to 1.5x the amount wrongfully withheld (§58-2550(c)))
The law
Kan. Stat. Ann. §58-2550

The rule

Balance returned within 14 days after the landlord determines deduction amounts, but in NO event later than 30 days after termination of the tenancy + delivery of possession + written demand by the tenant. If the tenant makes no demand within 30 days, the landlord must mail the deposit due to the tenant's last known address.

Watch out in Kansas:
  • Unique 3-trigger clock: termination + delivery of possession + written tenant demand
  • No demand within 30 days → landlord must mail to last known address
  • Deposit caps: 1 month's rent unfurnished / 1.5 months furnished; separate pet deposit up to 0.5 month
  • Tenant may NOT apply the deposit to last month's rent — doing so forfeits the deposit (§58-2550(d))

What happens if your landlord misses the deadline

In Kansas, a missed deadline seriously weakens your landlord's position. Depending on the circumstances, they may forfeit the right to deduct anything at all, owe you the penalty above, or both. The exact consequence depends on Kan. Stat. Ann. §58-2550 and whether they provided the required itemized statement. Don't assume the money is gone — a missed deadline is often the strongest fact pattern for getting it back.

Your next steps in Kansas

  1. Confirm the clock ran. Make sure you provided a forwarding address in writing, and that the full deadline has passed.
  2. Send a demand letter citing Kan. Stat. Ann. §58-2550 and the 1.5x penalty. Most landlords pay at this stage.
  3. If they ignore it, file in small claims. See our walkthrough for the process.

Kansas deposit questions

How long does my Kansas landlord have to return my deposit?

Balance returned within 14 days after the landlord determines deduction amounts, but in NO event later than 30 days after termination of the tenancy + delivery of possession + written demand by the tenant. If the tenant makes no demand within 30 days, the landlord must mail the deposit due to the tenant's last known address.

What if my landlord never sends an itemized list of deductions?

In most states — including Kansas — failing to provide the required itemized statement within the deadline forfeits the landlord's right to withhold anything. Check Kan. Stat. Ann. §58-2550 for the exact rule.

Can I get more than my deposit back in Kansas?

Kansas law allows 1.5x for failure to comply with the return rules — tenant recovers the deposit due plus damages equal to 1.5x the amount wrongfully withheld (§58-2550(c)). See our penalties guide for how judges apply this.
