Minnesota Security Deposit Return Deadline
- Penalty for missing it
- 2x + up to $500 (two layers: (a) failure to comply at all — landlord returns full deposit + interest + a penalty equal to the amount withheld (effectively up to 2x the withheld amount); (b) bad-faith retention — punitive damages up to $500 (bad faith presumed if landlord violated the return rules and doesn't pay within 2 weeks after the tenant files suit) (§504B.178, subds. 4, 7))
- The law
- Minn. Stat. §504B.178
The rule
3 weeks (21 days) after termination of the tenancy AND receipt of the tenant's mailing address. If the landlord fails to return the deposit or furnish a written statement, they forfeit the right to withhold any portion (§504B.178, subd. 7).
- Interest: deposits must accrue 1% simple interest per year, paid when the deposit is returned.
- No deposit cap under state law.
- Landlord must furnish a written statement showing the specific reason for withholding.
What happens if your landlord misses the deadline
In Minnesota, a missed deadline seriously weakens your landlord's position. Depending on the circumstances, they may forfeit the right to deduct anything at all, owe you the penalty above, or both. The exact consequence depends on Minn. Stat. §504B.178 and whether they provided the required itemized statement. Don't assume the money is gone — a missed deadline is often the strongest fact pattern for getting it back.
Your next steps in Minnesota
- Confirm the clock ran. Make sure you provided a forwarding address in writing, and that the full deadline has passed.
- Send a demand letter citing Minn. Stat. §504B.178 and the 2x + up to $500 penalty. Most landlords pay at this stage.
- If they ignore it, file in small claims. See our walkthrough for the process.
