The rule

30 days after termination of the lease. The landlord must return the deposit plus the tenant's share of interest, minus an itemized list of deductions. If the tenant is evicted, the deposit may be applied to back rent (N.J.S.A. 46:8-21.1).

Watch out in New Jersey:
  • Deposit cap: 1.5 months' rent; must be deposited in an interest-bearing account and the landlord must notify the tenant of the bank in writing.
  • Owner-occupied buildings with 2 or fewer units are exempt from the Security Deposit Act.
