Rhode Island Security Deposit Return Deadline

20 days
How long your Rhode Island landlord has to return your deposit
Penalty for missing it
2x (twice the deposit) (wrongful failure to comply — the amount owed plus damages of 2x that amount plus reasonable attorney's fees (§34-18-19))
The law
R.I. Gen. Laws §34-18-19

The rule

20 days after the LATER of: termination of tenancy, delivery of possession, or the tenant providing a forwarding address (R.I. Gen. Laws §34-18-19). Note: many older sources say 30 days — they are stale.

Watch out in Rhode Island:
  • CORRECTED: 20 days, not 30 — most secondary sources are outdated.
  • Deposit cap: 1 month's rent (plus 1 more month for furnished units with furnishings over $5,000).
  • The clock starts on the latest of three events — if you delay your forwarding address, you delay your own refund.

What happens if your landlord misses the deadline

In Rhode Island, a missed deadline seriously weakens your landlord's position. Depending on the circumstances, they may forfeit the right to deduct anything at all, owe you the penalty above, or both. The exact consequence depends on R.I. Gen. Laws §34-18-19 and whether they provided the required itemized statement. Don't assume the money is gone — a missed deadline is often the strongest fact pattern for getting it back.

Your next steps in Rhode Island

  1. Confirm the clock ran. Make sure you provided a forwarding address in writing — in Rhode Island this step starts the clock, so it matters more than usual, and that the full deadline has passed.
  2. Send a demand letter citing R.I. Gen. Laws §34-18-19 and the 2x (twice the deposit) penalty. Most landlords pay at this stage.
  3. If they ignore it, file in small claims. See our walkthrough for the process.
Get the letter written for you. The $19 Deposit Recovery Kit generates a Rhode Island demand letter citing R.I. Gen. Laws §34-18-19, with your dates and deposit amount filled in — plus a small-claims walkthrough.

Rhode Island deposit questions

How long does my Rhode Island landlord have to return my deposit?

20 days after the LATER of: termination of tenancy, delivery of possession, or the tenant providing a forwarding address (R.I. Gen. Laws §34-18-19). Note: many older sources say 30 days — they are stale.

What if my landlord never sends an itemized list of deductions?

In most states — including Rhode Island — failing to provide the required itemized statement within the deadline forfeits the landlord's right to withhold anything. Check R.I. Gen. Laws §34-18-19 for the exact rule.

Can I get more than my deposit back in Rhode Island?

Rhode Island law allows 2x (twice the deposit) for wrongful failure to comply — the amount owed plus damages of 2x that amount plus reasonable attorney's fees (§34-18-19). See our penalties guide for how judges apply this.
